Special Education

Because of our background and experience in both education law and disability within our own lives, the attorneys and staff at Wiscarson Law understand the impact that a special needs child can have on an entire family – including the crushing financial effect. Throughout the history of Wiscarson Law, we have always been sensitive to this issue and have developed a law practice that is efficient and serviceable for parents.

Our attorneys will review each child’s educational situation on a case-by-case basis, and then help parents figure out whether legal representation is necessary. To do that effectively, parents are never charged for an initial consultation.

At an initial consultation, our attorneys will meet with you, review your educational documents, assess your child’s unique educational issues and explore options. At the end of the consultation, we can help you decide whether your child needs legal representation, and if so, how we can best serve your child. If you do not need an attorney, we will forthrightly tell you so, and help you plan your next steps.

Wiscarson Law employs managerial, administrative, law clerk, advocacy, clerical, and paralegal staff as appropriate, to meet client needs in the most economically responsible manner.

Education law is a complex and constantly evolving myriad of federal, regional, and state rules, regulations, and cases. As a parent, it is difficult to understand this ever-changing area of law and figure out how to apply it to your child’s unique situation. Wiscarson Law can help you by working with you and your school district or education service district in a variety of ways, including:

• Helping develop and implement an Individualized Family Service Plan (IFSP), an Individualized Education Plan (IEP) or a § 504 Plan;
• Guiding parents through the special education process;
• Talking to public education personnel;
• Providing “behind the scenes” legal advice or assistance;
• Attending meetings;
• Assisting with eligibility determinations for special education services;
• Helping determine and ensure appropriate specially designed instruction;
• Helping find and secure an appropriate placement;
• Filing Complaints and Due Process Complaints with State Departments of Education;
• Advocating in special education mediations;
• Negotiating settlements;
• Attending disciplinary proceedings for regular and special education students; and
• Helping navigate other educational issues for successful resolutions.

Guardianship

When you need help establishing or maintaining a guardianship, conservatorship, or temporary fiduciary, Wiscarson Law can assist you throughout all phases of the process. Our attorneys are knowledgeable about the intricacies of State requirements. We will discuss with you the extent to which your loved one is unable to independently manage their personal or financial matters, help decide which kind of fiduciary best fits their needs, and then file the necessary paperwork to commence the proceeding.

Higher Education

The explosion in the number of people pursuing education and training after high school has led to more conflicts for students with disabilities as they try to access programs and obtain equal opportunities. Wiscarson Law can help you with all disability-related disputes, including ADA accommodations, claims of discrimination, sexual harassment, and breach of contract. Our attorneys will help you consider all of your options, including the institutional grievance process, filing a civil action in state or federal court, or submitting a complaint to the U.S. Department of Education’s Office for Civil Rights.
