A woman called from 678-265-3904, said she was with Portfolio Recovery Associates and was calling to collect a utility bill. The problem was, the person she asked for never lived at our home and we never had an account with the utility company she was trying to collect for. She hung up on me too after I called her a scammer.

That's all you have to do. You took advantage of the goods & services of others and thought you could screw them over with out consequence. Now you have to pay up. So pay up and STFU.

I received correspondence from this company claiming to represent Ford Motor Credit Company. Already a red flag because I have never purchased a car nor have I had a car in my name. Stacy, I have bad news for you

If this company files suit against the OP, all he can do is show up in court, and present a defense that the debt is past the SOL.  The judge will dismiss the law suit, and the company will not be able to sue again.  However  the OP cannot SUE the collection agency for doing this.  Any body can file a law suit any time, it is their right.

The consumer (discharged debtor) has to also prove actual damages in his case against the collector. If the collector has been particularly egregious than punitive damages can be awarded by the BK judge. Remember, we are not talking about a violation of the automatic stay...
