You are mistaken.  In New York State, whenever there are assets in the estate, there must be an executor of the estate.  If the will does not name an executor, then the PROBATE COURT will name an executor.

My Thoughts

When it comes to money, everyone should be on guard. Family everyday turn on each other in regards to money. I don't think it was right that Theresa's sister was not present at the time of will being done. It clearly shows that Theresa was up to something fishy and not knowing the amount and her balance clearly shows something not legal is going on. I would consult an attorney to look into this...
